The German Bundestag decided in its session on December 17, 2020, to shorten the discharge of residual debt proceedings from 6 to 3 years. From now on, personal bankruptcies and regular bankruptcies will therefore last a maximum of three years for everyone!
The main changes in detail:
The shortening of the bankruptcy proceedings to three years is to apply retroactively to all bankruptcy proceedings filed from October 1, 2020.
A transitional regulation has been established for bankruptcy applications submitted between December 17, 2019, and September 30. These bankruptcy proceedings will be shortened by the time that has passed since July 16, 2019.
For your bankruptcy application from October 1, 2020, the discharge of residual debt phase is reduced to three years. A minimum quota is no longer required.
